Jack Smith's report says Trump 'knew there was no fraud' in 2020

Special counsel Jack Smith's report on his investigation of United States President-elect Donald Trump's alleged 2020 election interference said that Trump spread "demonstrably and, in many cases, obviously false" claims in his efforts to cling to power.

The election interference-related volume of Smith's two-volume report on his now-defunct criminal cases against Trump, obtained by NBC News, claimed that Trump "knew that there was no outcome-determinative fraud in the 2020 election, that many of the specific claims that he made were untrue, and that he had lost the election." Smith also said in the report that he believed enough evidence was gathered to convict Trump in a trial, had he not won the 2024 election, thus making it impossible for the prosecution to continue.

"Indeed, but for Mr. Trump's election and imminent return to the presidency, the office assessed that the admissible evidence was sufficient to obtain and sustain a conviction at trial," Smith wrote. In a letter attached to the report, he stressed that the ultimate decision to bring charges against Trump was solely his and that he stands "fully" behind it.
